Terms of Service
These Terms of Service govern the supply, installation, and servicing of electrical and solar products by Impressive Electrical & Solar Pty Ltd (ABN 51 616 534 751). By engaging Impressive or accepting a quote, users agree to these terms.
1. Customer Responsibilities
- Proceeding with a quote, payment, or installation indicates acceptance of these Terms of Service.
- All information provided to IES must be accurate, particularly in relation to eligibility for government incentives (e.g. STCs, rebates).
- Customers must ensure their premises are compliant and suitable for installation, including:
- Structural integrity of the roof
- Electrical wiring meeting current standards
- Safe and unhindered access to the meter box, switchboard, roof and inverter location
- Appropriate permissions from landlords or body corporate where applicable
- All necessary council approvals and planning permissions
- Any required pre-installation work such as switchboard upgrades, rewiring, or roof repairs is the customer’s responsibility.
2. Small-scale Technology Certificates (STCs)
- Customers agree to assign all rights to applicable government incentives, including STCs, to IES in exchange for a point-of-sale discount.
- If a customer is ineligible or a shortfall in STC value occurs, the customer is liable for the difference.
3. Installation Terms
- Installations are carried out by licensed and qualified professionals.
- IES may reschedule installations due to weather or unforeseen events.
- While IES aims to maximise system performance, actual output depends on site-specific factors including orientation, shading and panel placement.
- Customers are responsible for providing safe site access and, where relevant, spare roof tiles.
- Any variations or relocations after installation (e.g. due to neighbour or council complaints) are at the customer’s expense.
- Ownership of installed goods transfers only upon full payment. Any stored or partially installed equipment remains the customer’s responsibility against theft or damage.
4. Payments and Fees
- Final payment is due on the day of installation unless otherwise agreed in writing.
- Overdue accounts incur 10% interest.
- Credit card payments attract a 2.2% processing fee.
- All quoted amounts are GST exclusive unless stated otherwise.
5. Liability
IES is not liable for:
- Delays caused by factors outside our control (e.g. weather, supplier issues, regulatory delays)
- Damage or faults due to non-compliant pre-existing wiring or plumbing
- Losses resulting from customer actions or failure to comply with these Terms
6. Metering and Grid Connection
- Grid connection and meter upgrades may require separate fees and are dependent on the relevant network authority or energy provider.
- IES is not responsible for delays in grid connection, feed-in tariff rates, or any additional compliance costs imposed by energy authorities.
7. Warranties and Consumer Rights
- Installation workmanship is covered by a 10-year warranty.
- Product warranties are provided by the respective manufacturers. IES will assist with warranty claims where possible.
- Warranty callouts are limited to business hours and must be performed by IES or authorised personnel. Callouts for inspection, blown fuses, or unrelated faults are chargeable.
- Our services and products come with guarantees under the Australian Consumer Law. Customers may be entitled to a repair, replacement, or refund depending on the nature of any failure.
8. Cooling-Off Period and Contract Termination
- Customers are entitled to a 10-day cooling-off period from the date of contract signing or deposit payment, whichever is earlier.
- Either party may terminate the contract if the other breaches its obligations.
- Post-cooling-off cancellations may incur fees to cover work, materials, and associated costs. Deposits may be forfeited.
- IES reserves the right to cancel installations where premises are unsafe, access is denied, or pets are not secured.
9. Changes to Government Incentives
- Should relevant rebate or incentive programs be significantly altered or cancelled, either party may cancel the agreement without penalty.
10. Legal Framework
- These Terms are governed by the laws of New South Wales.
- Where applicable, the Building and Construction Industry Security of Payment Act 1999 (NSW) applies.
