These Terms of Service govern the use of this website and the provision of products and services by Impressive Electrical & Solar Pty Ltd (IES, we, us, our). By using our website, requesting a quote, accepting a proposal, or engaging our services, you agree to these terms.

IES is a signatory to the New Energy Tech Consumer Code (NETCC) and operates in accordance with its requirements.

1. Acceptance of Terms

By accessing our website, requesting services, accepting a quotation, paying a deposit, or signing an agreement with us, you acknowledge that you have read and agree to these Terms of Service.

These terms apply in addition to any written contract or quotation issued by IES.

2. Your Responsibilities

You agree that all information provided to us regarding your property, electrical infrastructure, and eligibility for incentives is accurate and complete.

You are responsible for:

  • Ensuring compliance with local council requirements, planning laws, or strata approvals
    • Obtaining any necessary owner, landlord, or body corporate consent
    • Ensuring the roof structure and electrical systems are safe and suitable for installation
    • Providing safe and reasonable access to the property for inspection and installation
    • Ensuring the premises complies with applicable electrical safety regulations

Where existing infrastructure is unsafe, outdated, or non-compliant, additional work may be required. This may include:

  • Electrical supply upgrades
    • Safety switch installation
    • Switchboard upgrades
    • Meter panel upgrades
    • Meter box compliance works

Any additional required works will be discussed with you before proceeding.

3. Government Incentives and STCs

Small-scale Technology Certificates (STCs) are created under the Australian Government renewable energy scheme. The value of STCs is determined by the market and may change.

By accepting a quotation from IES that includes a point-of-sale discount related to STCs or similar incentives, you agree to assign to IES the rights to create and receive those certificates.

If:

  • you are not eligible for STCs, or
    • the certificates received are fewer than expected

you may be required to pay the difference between the discount applied and the value received.

If government policy or incentive programs materially change before installation occurs, either party may terminate the agreement and a refund will be provided in accordance with our refund terms.

4. Installation Services

By engaging IES, you authorise us to supply and install the agreed system at the nominated property.

Installation timeframes are estimates only and may be affected by factors outside our control, including:

  • weather events
    • supplier delays
    • network approvals
    • safety considerations
    • site access issues

IES will take reasonable care during installation. Where roofing materials are aged or brittle, tile breakages may occasionally occur. Replacement tiles should be provided by the property owner where possible.

Ownership of supplied equipment remains with IES until payment has been received in full.

Unless otherwise agreed in writing, final payment is due on the day installation is completed.

Overdue amounts may incur interest at a rate of 10 percent per annum. Credit card payments may incur a processing fee.

5. System Performance

Any performance estimates, energy forecasts, or savings projections are based on available data and standard modelling tools.

Actual system performance may vary due to factors including:

  • shading
    • roof orientation
    • weather conditions
    • system maintenance
    • electricity consumption patterns

For this reason, IES cannot guarantee specific energy production or financial outcomes.

6. Grid Connection and Metering

Where grid connection approval or meter upgrades are required, IES may assist in managing the process on your behalf.

This process may include:

  • application submission to the network distributor
    • receipt of approval to connect
    • system installation
    • compliance documentation submission
    • meter reconfiguration or installation by the authorised meter provider
    • final commissioning

Certain stages of this process are controlled by electricity distributors and retailers. IES is not responsible for delays caused by these third parties.

You may choose to manage the connection process yourself. If so, we will provide the necessary documentation and technical details.

IES does not control or guarantee feed-in tariff rates offered by electricity retailers.

7. Warranties

Manufacturer warranties apply to individual system components. Details are typically provided within your quotation or proposal documentation.

IES provides a 10-year workmanship warranty on installation.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage.

For issues that are not major failures, you agree to provide IES a reasonable opportunity to inspect and rectify the issue.

Routine maintenance is not included unless specifically stated.

8. Limitation of Liability

Nothing in these Terms of Service excludes or limits any rights you have under the Australian Consumer Law.

To the extent permitted by law, IES is not liable for indirect, incidental, or consequential loss arising from the use of our products, services, or website.

9. Applicable Legislation

Where relevant, the Building and Construction Industry Security of Payment Act 1999 (NSW) may apply to services performed.

10. Cancellations, Cooling-Off and Refunds

Cooling-off period

Customers are entitled to a 10 business day cooling-off period from the date of signing a contract or paying a deposit, whichever occurs first.

Full refund circumstances

A full refund may be provided if:

  • you do not consent to the final system design after receiving the detailed proposal
    • a significant design change is required and you do not accept the revision
    • unforeseen site conditions require substantial additional work not included in the original price
    • IES fails to deliver installation within the agreed timeframe, unless delays are outside our control

After installation has commenced

If installation has begun and the agreement is terminated for reasons other than those listed above, reasonable costs already incurred may be deducted from any refund.

11. Complaints and Dispute Resolution

If you have a complaint, please contact us first so we can attempt to resolve the matter.

You may also contact the Energy & Water Ombudsman NSW for independent dispute resolution.

12. Governing Law

These Terms of Service and any agreements with IES are governed by the laws of New South Wales, Australia.
